ESOS Energy Savings Opportunity Scheme

Who will it affect?

Article 8 of the ‘EU Energy Efficiency Directive’ requires each Member State to instruct every ‘large enterprise’ to conduct a Phase 2 Energy Audit and file proof of compliance by 5 December 2019. The UK version is called the ‘Energy Savings Opportunity Scheme’ (ESOS) and will apply to large undertakings which meet any one of the following criteria :

  • 250 employees or more ; or
  • Annual turnover exceeding €50m and a balance sheet exceeding €43m ; or
  • Part of a corporate group which includes a large undertaking.

For the Phase 2 period of this scheme the qualification date for compliance is the
31 December 2018. To ensure compliance, Companies are required to audit assets and activities that amount to 90% of their total energy consumption over a continuous period of at least 12-months. All audits and any associated reporting must be completed in good time to file proof of compliance with the Environment Agency by 5 December 2019.

Routes to Compliance

The government has announced a number of routes to compliance including new ESOS compliant energy audits, ISO 50001 certification, Green Deal Assessments and Display Energy Certificates. If your organisation is fully covered by ISO 50001, there is no need to perform any additional audits for compliance with the ESOS Energy Savings Opportunity Scheme.

ESOS and participation in other schemes (EU ETS, Climate Change Agreements, CRC, GHG)

The scope of energy required to be included in the assessment of your total energy consumption under ESOS is broader than the mandatory and voluntary schemes. You will need to incorporate any additional energy use that is not covered by an existing scheme so that the 90% audit coverage target is achieved, which must also include transportation and energy supplied by landlords.
